The owner of the website and the website domain www.profilplast.si (hereinafter: the website) is Profilplast, orodjarstvo in plastika, d.o.o. (hereinafter Profilplast, d.o.o.)
The website www.profilplast.si and all information, product images, graphic and video elements on the website are protected and may not be reproduced or used without the prior written permission of the owner.
Types of users
The buyer can be a natural or legal person, taking into account the information provided when requesting an offer and placing an order. A natural person is exclusively a user who acquires or uses goods and services for purposes outside of his professional or gainful activity. The provisions of the Consumer Protection Act apply to natural persons.
When the buyer is a natural person, these general conditions and the Consumer Protection Act govern mutual obligation of Profilplast d.o.o. and users.
Availability of information
Profilplast, d.o.o. commits to always providing the buyer with the following information:
- company identity (name and registered seat of the company, registration and tax number),
- contact information that enables the user to communicate quickly and efficiently (e-mail, telephone),
- essential characteristics of goods or services (including after-sales services and guarantees),
- product availability (every product offered on the website should be available within a reasonable time); when ordering a custom-made product, we agree on a production deadline that depends on the complexity of the order,
- conditions of product delivery (method, place and deadline of delivery),
- all prices must be clearly and unambiguously determined, it must be clearly shown whether they already include taxes and transport costs,
- method of payment and delivery,
- time validity of the offer,
- the period during which the buyer, who is a natural person, can withdraw from the contract and the conditions for withdrawal; in addition, whether and how much it costs the customer to return the product and
- explanation of the complaint procedure, including all information about the contact person or customer service department.
Offer of products and prices
The price is the regular price of the product, but due to the nature of the business, prices may be updated and changed. All prices include VAT. The prices are valid at the moment of placing the order and have no further validity.
Orders and delivery
Sales contract between Profilplast, d.o.o. and the buyer is concluded the moment the buyer confirms his order via e-mail or phone. From this moment on, all prices and other conditions are determined and apply to Profilplast, d.o.o. as well as the buyer. The sales contract (i.e. the first electronic message about the status of the order) is stored in electronic form on the server of Profilplast, d.o.o. and is available to consumers upon written request.
Profilplast, d.o.o. enables the following payment methods:
- with cash upon collection via Pošta Slovenije, DPD or Slovenske železnice;
- by a pro forma invoice (UPN order) to the company’s account;
- in cash at the business premises of Profilplast d.o.o.
Packaging and delivery costs depend on each package separately (depending on the weight and length of the package). The buyer is aware of the cost of home delivery before ordering the goods.
Warning: These conditions and packaging and delivery costs apply only in the Republic of Slovenia.
The delivery of ordered goods is carried out by the delivery services of Slovenske železnice, DPD and Pošta Slovenije (usually in the morning). If there is no one at the specified address at the time of delivery, the courier will leave a message or contact you by phone. We will inform you about the dispatch of the shipment by e-mail or telephone.
If the buyer does not accept the sent goods, all costs of failed deliveries are borne by him.
Issuance of an invoice
After delivery and payment of the ordered items, Profilplast, d.o.o. will send the customer an invoice, in physical form to the customer’s address. The price and all costs related to the purchase will be detailed on the invoice. The buyer is obliged to check the correctness of the data before placing the order.
Purchase notification process
After submitting the order, the buyer receives a notification by e-mail or by phone that the order has been accepted. Profilplast, d.o.o. can call the customer on the provided phone number to check the data or ensure the accuracy of the delivery.
The purchase process for legal entities is exactly the same as for natural persons, except that before confirming the order, they must also provide the name of the company. There are also the same payment options.
The consumer’s right to withdraw from the contract
In the case of contracts concluded at a distance, the consumer (i.e. a natural person) has the right, in accordance with the Consumer Protection Act, to notify the company unequivocally of his withdrawal from the contract within 14 days. He can do so by sending the message to this e-mail address (firstname.lastname@example.org) or via any other communication channel, stating that he withdraws from contract, without having to give a reason for this decision.
The consumer must return the goods to the company no later than 14 days after the notification of withdrawal from the order. The consumer returns the goods to the address: Profilplast, d.o.o., Zavrh nad Dobrno 10, 3204 Dobrna, Slovenia. The only cost charged to the consumer in connection with the cancellation of the order is the direct cost of returning the goods.
The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer.
When returning the goods, the consumer also provides the invoice for the goods and personal data, as well as the transaction account to which he wishes to receive a refund. We will refund the payment within 14 days of receiving the notice of withdrawal from the contract.
The buyer as a consumer does not have the right to withdraw from the contract when the object of the order is custom-made goods, as stipulated in Article 43 of the Consumer Protection Act.
If a legal or natural person engaged in a profit-making activity, regardless of its legal organizational form or ownership, makes the order and if the purchase is not made based on a contract concluded at a distance, the provisions on resignation do not apply.
Limitation of liability
Profilplast, d.o.o. makes every effort to ensure that the information published on our website is up-to-date and correct. Nevertheless, the characteristics of the items, the delivery period or the price can change so quickly that Profilplast, d.o.o. might not manage to correct data on its website. In such a case, Profilplast, d.o.o. will informe the customer about the changes and allow him to withdraw from the contract or exchange the ordered item.
Exclusion of liability
We reserve the right to disable the website or disable access to it due to technical or other problems and maintenance. You yourself must ensure adequate equipment protection (antivirus, etc.) before accessing and using the website.
Complaints and disputes
Profilplast, d.o.o. respects the applicable European legislation on consumer protection. Profilplast, d.o.o. makes every effort to fulfill its duty to establish an effective complaint handling system and to designate a person that the buyer who is a consumer can contact by phone or e-mail in case of problems.
The complaint can be submitted via the e-mail address email@example.com. The appeal process is confidential. Profilplast, d.o.o. will sent the customer the confirmation of receiving the complaint within five working days, inform the customer about how long it will take to process it, and keep him informed of the progress of the procedure.
Profilplast, d.o.o. is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. That is also the main obstacle for the consumer not to initiate a dispute before the court. For that reason Profilplast, d.o.o. will make every effort to resolve any disputes amicably.
Jurisdiction for judicial settlement of disputes is the court, based on the permanent residence of the consumer.
Out-of-court settlement of consumer disputes
In accordance with legal norms (Article 32 of the Out-of-Court Settlement of Consumer Disputes Act, hereinafter ZiSRPS), we do not recognize any provider of out-of-court resolution of consumer disputes as competent to resolve a consumer dispute that a consumer could initiate in accordance with ZiSRPS.
Profilplast, d.o.o., who as a provider of goods and services facilitates the conclusion of distance contracts in the territory of Slovenia, provides a link on its website to the platform for the online resolution of consumer disputes (SRPS). The aforementioned regulation comes from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) No. 524/2013 of the European Parliament and the Council on online resolution of consumer disputes and amendments to Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
